These Terms govern your use of areweup.ca (the "Service"), operated by Whyle Labs Inc. ("we", "us"). By creating an account or using the Service, you agree to these Terms.
areweup.ca lets you configure automated checks ("Probes") against endpoints you specify and notifies you when they fail or respond slowly.
Probe results are provided for informational purposes only. A successful Probe does not guarantee that an endpoint is functioning correctly, and a failed or slow Probe does not necessarily mean that the endpoint is unavailable to its users.
You're responsible for keeping access to at least one device or recovery method (your email address) that can sign in to your account. We use your email to send verification codes, account recovery messages, and Probe alerts you've configured - see our Privacy Policy.
Some plans require you to log in at least once every 12 months to keep your account active. An account on such a plan that goes a full year without a log-in may be considered abandoned and deleted.
You agree not to use the Service to monitor endpoints you don't own or have authorization to monitor at the frequency configured, to abuse or overload third-party systems, to conduct unauthorized vulnerability or port scanning, to circumvent usage limits, or to violate applicable law.
You also agree not to use the Service to facilitate attacks against third parties, including denial-of-service attacks or other activity intended to disrupt or impair systems or networks.
We may enforce reasonable usage limits on Probe count, polling frequency, and bandwidth or other resource consumption beyond what a plan allows, to keep the Service reliable for all users. If your usage exceeds these limits, we may throttle, suspend, or ask you to upgrade your plan before restoring full service.
Paid plans are billed according to the pricing and billing terms presented when you subscribe. Unless otherwise stated, subscriptions automatically renew until cancelled.
You may cancel a paid plan at any time. Cancellation takes effect at the end of the applicable billing period unless otherwise stated. We may suspend paid features if payment is unsuccessful or amounts due remain unpaid.
You retain ownership of information and configurations you submit to the Service. You grant us the rights reasonably necessary to store, process, transmit, and otherwise use that information to provide, maintain, secure, and improve the Service.
We handle personal information and retain account and Service data as described in our Privacy Policy.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service or monitoring will be uninterrupted, timely, accurate, or error-free, and we are not liable for missed, delayed, inaccurate, or false alerts. Do not rely on this Service as your sole means of detecting a critical outage.
The Service, including its software, design, branding, and content, is owned by Whyle Labs Inc. or its licensors and is protected by applicable intellectual-property laws. These Terms do not grant you ownership of the Service.
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, misuse the Service, fail to pay amounts due, or if reasonably necessary to protect the Service, our users, or third parties.
We may also discontinue or materially change the Service at any time.
When you delete your account, we will delete or anonymize your account data in accordance with our Privacy Policy and applicable law.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding the Service, including warranties of availability, accuracy, reliability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Whyle Labs Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service, including damages resulting from a missed, delayed, inaccurate, or false alert.
To the maximum extent permitted by law, our total aggregate liability arising from or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service during the 12 months preceding the event giving rise to the claim, or (b) $10 CAD.
We may update these Terms as the Service evolves. Changes will become effective when posted unless we specify a later effective date. Material changes may also be communicated through the Service or by email.
By continuing to use the Service after changes become effective, you agree to the updated Terms.
These Terms are governed by the laws of Ontario, Canada. To the maximum extent permitted by law, the courts of Ontario, Canada will have exclusive jurisdiction over disputes arising from these Terms or your use of the Service.
